eccuity Invest Background

eccuity Invest New Zealand Limited operates as part of the Maddition Group, a wealth management technology enterprise. The company partners with global firms to provide investment product access, though it does not create, issue, or own these products. Users should carefully review each product's terms to assess suitability and understand risks before investing.

Account Creation Requirements

Users must be:

eccuity retains discretion to cancel or refuse accounts without notice or explanation.

Users must keep account information current and maintain strong passwords. eccuity disclaims liability for unauthorized account use but reserves suspension rights for suspected compromise or illegal activity.

eccuity Invest Terms

When opening an account including Alpaca brokerage access, this becomes the "eccuity Invest Account." eccuity reserves modification rights with four-week email notice for material changes. Users may cancel within four weeks of notification if disagreeing with changes; continued use indicates acceptance.

Your eccuity Invest Account

Funds deposited to Kiwi Bank accounts held in trust transfer to Alpaca Securities. Using Wise Payments Limited or Ebury, funds typically arrive within three business days, though eccuity targets one-day availability. Foreign exchange fees are communicated via email.

Funding an Account

Deposits require account funding before purchasing securities. eccuity may offer different payment methods and speeds with associated fees, changeable at its discretion. Deposited funds become withdrawable after approximately seven business days once cleared.

Users authorize eccuity and service providers to facilitate fund transfers to Alpaca's U.S. client account. Foreign exchange conversion occurs at receipt time rather than sending time. Exchange rate estimates may differ from actual rates for non-instant transfers.

Users confirm funds are not for improper or illegal activities. Direct funding through non-eccuity channels is unsupported; third-party deposits may be rejected and accounts suspended with potential fees. International funding is prohibited.

eccuity maintains accurate fund records and proper transfer amounts but disclaims liability for exchange rate fluctuations or banking delays. Users should report statement discrepancies promptly.

Unique reference codes are essential for transfers; unmatched codes result in returns to original accounts with email notification. Upon account closure, investments sell within X days (subject to change) with funds minus applicable fees returning to users' banks.

Alpaca serves as custodian or sub-custodian for investments, not eccuity directly.

eccuity Invest Availability

Services operate fully between 08:00-18:00 New Zealand Time, Monday through Friday. eccuity accepts no liability for unavailability outside these hours or due to reasons beyond its control.

Fees

While account opening is free, using platform services incurs fees. Current schedules appear at the pricing page.

How eccuity Makes Money

Revenue sources include:

• Stock/ETF trading fees (0.2-0.4% of order value)
• 50/50 revenue share with Alpaca on USD cash balances and payment for order flow
• 50/50 spread on crypto transactions (0.75%)
• 50/50 FX revenue share (1%) on NZD deposits/withdrawals with Wise or Ebury
• eccuity Private subscription offering premium features

Privacy Obligations

eccuity and partners collect personal details necessary for service delivery. Information is handled per the eccuity Invest Privacy Policy aligned with New Zealand Privacy Law. However, Alpaca operates under U.S. law without equivalent New Zealand privacy safeguards.

Users agree to information sharing with Alpaca and must read Alpaca's Privacy Policy.

eccuity Invest Partners With: Alpaca Securities LLC and Alpaca Crypto LLC

Alpaca is a U.S. broker-dealer providing brokerage services and holding investments as custodian or through sub-custodians. Users can purchase shares in 4,700+ companies, 1,200+ ETFs, and cryptocurrencies in fractional amounts.

Sign-up constitutes agreement to Alpaca's Account Application and Customer Agreement and Crypto Agreement. These documents outline both parties' responsibilities and limitations.

eccuity Private Terms and Conditions

eccuity Private is a premium membership tier offered by eccuity Invest New Zealand Limited. These terms supplement and should be read alongside the eccuity Invest Terms and Conditions and the eccuity Platform Terms and Conditions above.

Membership Overview

eccuity Private provides access to enhanced platform features, reduced foreign exchange rates, higher interest rates on uninvested capital, personalised guidance, advanced portfolio tools, and direct access to our investment team.

Membership is subject to eligibility criteria and eccuity retains the right to approve, decline, or revoke membership at its discretion.

Subscription and Billing

eccuity Private is billed annually. Payment is processed via Stripe; card details are not stored on eccuity systems. Subscriptions automatically renew unless cancelled before the billing anniversary.

A 14-day money-back guarantee applies to new eccuity Private subscribers from the date of signup. Post-14-day refunds are at eccuity's discretion.

Promotional or discounted pricing applies only to the specified period and reverts to standard pricing thereafter. eccuity may change pricing with reasonable notice; new rates apply at the next billing cycle.

Enhanced Rates and Benefits

eccuity Private members receive preferential foreign exchange rates and higher interest rates on uninvested USD cash. These rates are variable and may change at eccuity's discretion. Current rates are published on the pricing page.

Additional benefits may include priority support, access to eccuity Strategies, advisory bundles, and other premium features as published on the platform from time to time.

Advisory Services

eccuity Private may include access to advisory bundles and personalised guidance sessions. These services are provided for informational and educational purposes only and do not constitute personalised financial advice. Users remain responsible for their own investment decisions.

Cancellation

Members may cancel their eccuity Private subscription at any time. Upon cancellation, premium features remain accessible until the end of the current billing period. After expiry, the account reverts to the standard free tier.

Sole Use

eccuity Private membership is for the exclusive use of the subscribing account holder. Access to premium features may not be shared, transferred, or resold unless explicitly approved by eccuity.

eccuity Platform Terms and Conditions

The eccuity Platform functions as an informational tool for discovering assets (U.S. stocks, cryptocurrencies, ETFs) and connecting third-party broker accounts. It provides no financial advice.

eccuity makes no minimum uptime commitments but attempts reasonable operational maintenance. The company disclaims liability for computer system interference or damage from platform use or linked websites. Users must ensure downloaded content lacks viruses or malware.

eccuity may modify the platform, terms, information, products, or services without notice. While maintenance occurs regularly, eccuity doesn't guarantee updates. The company accepts no liability for information errors or outdated content.

Investment Strategies on eccuity Platform

Three strategy types are available:

Proprietary strategies for wholesale private clients under membership tiers

Passive Strategies:

Publicly accessible ETF-based buy-and-hold strategies including All-Weather Portfolio, Dave Ramsey 401k Clone, and Barefoot Investor Clone

Pro Strategies:

Curated portfolios from public 13F filings in three formats:

• Top 10 Holdings
• Top 25 Holdings
• Full Portfolio

Limitations:

Pro Strategies exclude derivatives and non-U.S. equities/ETFs. Top 10 and Top 25 use pro-rata scaling. 13F data may not reflect real-time positions, leverage, or hedging. Pro Strategies serve informational and educational purposes only without endorsing original fund managers.

No Financial Advice

The platform provides no personalized financial advice. Strategies and data are informational only, not investment recommendations. Users must conduct independent research and consult professional advisors before decisions.

User Responsibility and Compliance

Users acknowledge personal responsibility for investment decisions and applicable regulatory compliance. The platform doesn't execute trades, manage investments, or serve as a fiduciary.

By using the platform, users agree to these terms and acknowledge investment strategy inherent risks serve informational purposes only, not financial advice. Users should conduct due diligence or seek professional guidance before investing.

Promotions and Competitions

Additional terms may apply to specific campaigns, promotions, or contests. Participation requires agreement to relevant terms, which supersede general terms if inconsistent.

Purchases

Users may purchase premium services via subscription. eccuity reserves cancellation and access refusal rights without explanation.

Discount/Promotional Pricing:

Reduced rates apply only to specified periods (maximum 12 months), reverting to standard pricing thereafter.

Price Changes:

eccuity may change pricing with reasonable subscriber notice. New rates apply at the next billing cycle.

Payment Methods and Security:

Stripe processes credit card payments; card details aren't stored on eccuity systems.

Cancellation:

Users cancel subscriptions anytime; partial refunds aren't guaranteed but may be offered at eccuity's discretion.

Refunds:

A 14-day money-back guarantee applies to new subscribers from signup. Post-14-day refunds occur at eccuity's discretion.

Subscription Fees:

eccuity automatically debits credit cards initially and on billing anniversary dates until cancellation.

Sole Use:

Users cannot share premium feature access unless explicitly approved under their subscription level.

New Zealand Users:

Fees charged to NZ users include GST.

Linked Sites

The platform may contain third-party website links. eccuity provides no endorsement or responsibility for linked site content and maintains no control over those sites.

Intellectual Property Rights

eccuity owns or licenses all platform and content rights, including copyrights, designs, patents, trademarks, and intellectual property. Platform use and content access grants no rights transfer to users.

eccuity grants access licenses on stated terms and as authorized. "Social sharing buttons, infographic download feature, or with written permission any reproduction or redistribution of this Platform or the Content is prohibited and may result in civil and criminal penalties."

No Commercial Use

Outside affiliate/partnership programs and professional memberships, the platform is for personal, non-commercial use only. Users cannot modify, copy, distribute, transmit, display, perform, reproduce, publish, license, exploit, create derivatives from, transfer, or sell content, software, products, or services. Non-commercial platform use restrictions prohibit further commercial purposes, including advertising or revenue generation on external websites.

Unacceptable Activity

Prohibited acts include:

• Breaching privacy or legal rights
• Defaming or libeling company employees or individuals
• Uploading virus-containing files
• Posting non-authorized material including offensive, defamatory, racist, obscene, threatening, or pornographic content

eccuity reserves sole discretion to remove posted information without notice.

Warranties and Disclaimers

eccuity makes no warranties regarding platform completeness, accuracy, updates, uninterrupted access, error-free operation, virus-freedom, or security. eccuity reserves rights to restrict, suspend, or terminate access without notice and disclaims responsibility for resulting losses.

AI Assistant Note: "The eccuity AI Assistant uses GPT3.5 and has been fine tuned to not give any financial advice." Large Language Models are susceptible to hallucinations; responses require independent user validation. Access may be revoked for manipulation attempts.

Liability

"To the maximum extent permitted by law, in no event shall we be liable for any direct and indirect loss, damage or expense" from platform use, information reliance, or inaccessibility, including incorrect, incomplete, or outdated materials.

Cookies

The website uses cookies; disabled cookies may prevent proper site functionality.

Jurisdiction and Governing Law

"Your use of this Platform and these Terms are governed by the law of New Zealand and you submit to the non-exclusive jurisdiction of the Courts exercising jurisdiction in New Zealand."
